OFFICIAL SWEEPSTAKES RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited by law.
1.Entrant must be at least 18 years old and a legal resident of the 50 United States and the District of Columbia, physically located and residing therein, as of 12/17/08. Employees of DiVid Entertainment, LLC (�Sponsor�),its licensor and prize providers, Geeks.com, Modern Skate & Surf, their advertising or promotion agencies, those involved in the production, development, implementation or handling of the Underworld �Choose Your Side� Sweepstakes (�Sweepstakes�), any agents acting for, or on behalf of the above entities, affiliated companies, licensees, service providers, prize suppliers, any other person or entity associated with the Sweepstakes (collectively �Sweepstakes Entities�) and the immediate family members (defined as parents, spouse, children, siblings, grandparents) of each such employees, and all those with whom such employees are domiciled (whether related or not), are NOT eligible. Anyone who attempts to defraud or in any way tamper with the Sweepstakes will be ineligible.
2. HOW TO ENTER: Sweepstakes begins at 6:00:00 p.m. Pacific Standard Time (�PST�) on 12/17/08 and ends 11:59:59 p.m. PST on 01/30/09 (�Sweepstakes Period�). Visit Shakefire.com/underworld (�Sweepstakes Site�) and fill in required entry information. Limit one (1) entry per person/email address per 24 hour period. Entries in excess of that limit will be void. Entries must be received by 11:59:59 p.m. PT on 01/30/09. To enter, you must fill out the entry form and choose either "Lycan" or "Death Dealer", depending on which Grand Prize you are entering for a chance to win. The Sweepstakes Site's database clock will be the official timekeeper for this Sweepstakes.
3. SELECTION AND NOTIFICATION OF WINNER: Potential winners will be randomly selected in a drawing on or about 02/12/09 from all eligible entries received by Sponsor. Odds of winning depend on the total number of eligible entries received. Entries become the sole property of Sponsor and will not be returned. Potential winner (his/her parent/legal guardian(s) if potential winner is a resident of a jurisdiction that deems him/her to be a minor) will be notified by phone, mail and/or email. If a potential winner cannot be reached after 5 days from first notification attempt, or a potential winner is found to be ineligible or does not comply with the Official Rules, the prize will be forfeited and an alternate potential winner may be selected by a second random drawing in Sponsor�s sole discretion. Entrants agree to be bound by the Official Rules and any and all decisions of the judges, which are final and binding in all respects. Upon completion of the Sweepstakes, two (2) winners will be chosen, one for each Grand Prize.
4. Two (2) GRAND PRIZES:
(a) One (1) $1,500 Geeks.com Gift Certificate (Approximate Retail Value [�ARV�]: $1500.00); and
(b) One (1) $1,500 Modern Skate and Surf Gift Certificate (ARV: $1500.00)
Total ARV: $3,000.
5. PRIZE LIMITATIONS: All expenses not specifically included in the Grand Prize as described in these Official Rules are hereby excluded. Prize restrictions imposed by the applicable prize suppliers apply. Winner may not transfer the Grand Prize, substitute another prize or receive a cash equivalent. Sponsor, at its sole discretion, may substitute a prize or cash of equal or greater value for any reason. Any depiction of prizes is for illustrative purposes only. One Grand Prize per person.
Sweepstakes is subject to these Official Rules and all applicable federal, state and local laws. Winner is solely responsible for all taxes on prize. Sponsor is not responsible for delay in prize delivery.
6. WINNER�S RELEASE FORMS: Potential winner (his/her parent/legal guardian(s) if potential winner is a resident of a jurisdiction that deems him/her to be a minor) must execute, notarize and return within 5 days of receipt by potential winner an affidavit of eligibility, a liability release, a publicity release (where legal), and any other documentation that Sponsor requires. Except where prohibited by law and Sponsor�s Privacy Policy, winner�s acceptance of prize (or if winner is a resident of a jurisdiction that deems him/her to be a minor, his/her legal guardian�s acceptance of prize) is permission for Sponsor to use winner�s name, photo, likeness, biographical information, statements, voice, and address (city and state only) for advertising/publicity purposes worldwide and in all media, without further notice or compensation.
7. LIMITATION OF LIABILITY: By entering the Sweepstakes, each entrant forever and irrevocably releases the Sponsor, Sweepstakes Entities, and their respective parent companies, affiliates, subsidiaries, service providers, officers, directors, employees, agents, shareholders, successors and assigns, (collectively �Released Parties�) from any and all liability, claims, demands, proceedings, lawsuits, causes of action, judgments, damages, costs, losses, injuries, expenses of any kind (including, without limitation, property damage, personal injury and/or death) resulting from, arising from, or in connection with, the Sweepstakes and any element thereof, the participation or inability to participate in the Sweepstakes, the Grand Prize and the acceptance, possession, delivery of, use, misuse, defect in, or inability to use the Grand Prize, any typographical or other error in the printing, offering or announcement of prize or in these Official Rules or any promotional materials with respect to the Sweepstakes, any claims based on publicity rights, defamation or invasion of privacy, personal or proprietary rights. The Released Parties are not responsible if any prize is changed.
By entering the Sweepstakes, each entrant agrees: (a) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor which shall be binding and final; (b) to waive any rights to claim ambiguity with respect to these Official Rules; (c) to waive all of his/her rights to bring any claim, action, or proceeding against any of the Released Parties in connection with the Sweepstakes; (d) typographical errors in these Official Rules or any promotional materials, (e) any interruptions in or postponement, cancellation, or modification of the Sweepstakes, (f) human error, (g) incorrect or inaccurate transcription, receipt or transmission of any part of the entry, (h) interruption or inability to access the Sweepstakes, the Sweepstakes Site or any other Sweepstakes-related web pages, or any online service via the Internet due to hardware or software compatibility problems, (i) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, (j) any wrongful, negligent, or unauthorized act or omission on the part of any of the Sweepstakes Entities, or any of their agents or employees, (k) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof) or (l) the collection, use and/or sharing of entrant�s personally identifiable information by Sponsor or its designees.
By entering the Sweepstakes, entrant also grants Sponsor the right to use entry information for marketing purposes to the extent permitted by law and Sponsor�s Privacy Policy, and releases Sponsor from any claims or liability relating to such use. Additionally, by opting-in to specific offers from any of the Sweepstakes Entities, entrant�s entry information will be subject to their respective privacy policies and terms of service and entrant agrees to receive additional email communication from those companies. Entrants agree that none of the Sweepstakes Entities has made or is responsible for any representation or guarantee, express or implied, in fact or in law, relative to the prize.
8. If for any reason the Sweepstakes cannot run as planned, Sponsor reserves the right to cancel/modify/suspend the Sweepstakes and conduct the Sweepstakes from all eligible entries received, if any prior to, the cancellation, modification or suspension.. Sweepstakes Entities are not responsible/liable for multiple entries entered by other than human means or other mechanical means, or for entries that are late (including delayed data transmissions), illegible, mutilated, forged, tampered with, destroyed, incomplete, lost, misdirected mechanically duplicated, or entries otherwise not in compliance with Official Rules (and all such entries will be disqualified). Sweepstakes Entities are not responsible or liable for any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or any combination thereof, or any damage to an entrant�s or third person�s computer and/or its contents. In case of a dispute over the identity of the entrant who submitted the winning entry, the authorized account holder of the email address associated with that entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted email address. Said entrant must comply with these Official Rules and, at Sponsor�s sole discretion, may be required to provide proof of ownership of the email account
9. JURISDICTION: Any claims or lawsuits related to the Sweepstakes brought against Sponsor shall be brought in the federal or state courts of the State of California. By participating in the Sweepstakes, entrants agree to the jurisdiction and venue of such courts, and waive all objections to such jurisdiction and venue.
10. 11. All information collected by Sponsor in connection with the entries will be subject to Sponsor�s Privacy Policy available at the Sweepstakes Site.
